Terms of Use

Chapter 1 General Provisions
Article 1 (Purpose)
These Terms and Conditions are intended to stipulate the rights, obligations, and responsibilities of the hospital and members when using the Internet-related services provided by Viv Clinic (hereinafter referred to as the “Hospital”).
Article 2 (Validity and Change of Terms and Conditions)
(1) These Terms and Conditions shall become effective upon notification through the service.
(2) The Hospital may change these Terms and Conditions if there are important reasons for change, and
shall notify of the change at least 2 days prior to the revision, and the changed Terms and Conditions shall become effective upon notification or notice in the same manner as in Paragraph 1.
(3) If a member does not agree to the changed Terms and Conditions, he or she may request withdrawal of membership, and
if he or she continues to use the service after the effective date of the changed Terms and Conditions, he or she shall be deemed to have agreed to the changes in the Terms and Conditions.
Article 3 (Rules on Matters Other than the Terms and Conditions)
Matters not stipulated in these Terms and Conditions shall be governed by the provisions of the Framework Act on Telecommunications, the Telecommunications Business Act, the Promotion of Information and Communications Network Utilization Act, and other relevant laws and regulations.
Article 4 (Definition of Terms)
(1) Member: A person who has entered into a service use agreement with the hospital and has been issued a user ID (ID) and password.
(2) ID: A combination of letters or numbers selected by the member and approved by the hospital for the purpose of member identification and service use (hereinafter referred to as “ID”).
(3) Password: A combination of letters and numbers set by the member to confirm that the member matches the ID issued to the member and to protect the member’s own confidentiality.
(4) Termination: A member cancels the service use agreement after using the service.

Chapter 2 Membership Registration and Service Use
Article 1 (Establishment of Service Agreement)
(1) Membership is limited to domestic residents.
(2) Membership is limited to individuals, and companies, organizations, and corporations cannot register as members.
(3) Membership is established upon the hospital’s approval of the user’s application for use and the user’s agreement to the terms and conditions.
(4) When the user reads these terms and conditions and clicks the “Agree” button upon applying for membership, the user is deemed to have acknowledged and agreed to the terms and conditions.
Article 2 (Application for Use)
Anyone who wishes to use the service by registering as a member shall apply for use by providing personal information in the prescribed form set by the hospital.
Article 3 (Approval of Application for Use)
(1) Unless there are special circumstances, the hospital shall approve applications for use in the order in which they are received pursuant to Article 2 of Chapter 2.
(2) The hospital may restrict approval of applications for use in the following cases and may withhold approval until the reasons are resolved.
① When there is no room in service-related facilities
② When there are technical difficulties
③ When it is deemed necessary due to other circumstances of the hospital
(3) The hospital shall not approve applications for membership that fall under the following cases.
① When applying using another person’s name
② When applying not with your real name
③ When filling out the application form with false information
④ When applying for the purpose of disrupting the peace and order of society or public morals
⑤ When other application requirements set by the hospital are not met
(4) When approval of an application for use is reserved or not approved pursuant to Paragraph 2 or 3, the hospital must notify the applicant of this. However, this does not apply in cases where the hospital is unable to notify the applicant due to reasons not attributable to the hospital.
Article 4 (Protection of Personal Information)
(1) The hospital protects and respects the personal information of its members.
(2) The hospital collects information about its members through information provided by members for community activities, participation in various events, and other information collected during the use of services, and the member’s personal information is used for the purpose of fulfilling this agreement and providing services under this agreement.
(3) The hospital cannot provide, leak, or distribute the member’s personal information acquired in relation to the provision of services to a third party without the member’s consent, and cannot use it for commercial purposes. However, this does not apply in the following cases:
① When necessary for bill settlement for the provision of information and communication services
② When necessary for compiling statistics, conducting academic research or conducting market research and providing information in a form that does not allow the identification of specific individuals
③ When there is a request from a relevant agency in accordance with the procedures and methods stipulated for investigative purposes by relevant
laws and regulations ④ When there are special provisions in other laws
⑤ When there is a request from the Information and Communications Ethics Committee
(4) The hospital may provide personal information to a third party with the consent of the user in the following cases. Even in such cases, provision of personal information to a third party will only be made with the consent of the user, and if the user does not wish to have his or her personal information provided, he or she may refrain from using a specific service or participating in a specific form of promotion or event.
① When users have given prior consent
② When there is a request from an investigative agency in accordance with the provisions of the law or for investigative purposes in accordance with the procedures and methods stipulated by law
(5) When personal information is provided or shared, the procedure for obtaining consent is to notify members individually via email or in writing of who the providing organization and institution are, what personal information items are provided or shared, why such personal information must be provided or shared, and how and until when it will be protected and managed. If members do not consent, their information will not be provided or shared with the providing organization and institution.
In addition, members may withdraw their consent at any time for any information they have consented to being provided to a third party.
(6) Within the scope of Paragraph 3, the hospital may compile and use collective statistical data on the personal information of all or part of its members in relation to its business, and may transmit cookies to members’ computers through the service. In this case, members may change the settings of the browser on their computer to refuse to receive cookies or to be warned about the receipt of cookies.
(8) In addition, we strive to protect users’ personal information, including their registration information, in accordance with other provisions of the law. Regarding the protection of personal information of users, the relevant laws and the “Personal Information Protection Policy” established by the hospital shall apply.

Chapter 3 Obligations of the Contracting Parties
Article 1 (Obligations of the Hospital)
(1) Unless there are special circumstances, the hospital
shall make continuous and stable efforts to provide services in accordance with the provisions of these Terms and Conditions, and shall repair and restore the equipment without delay when it becomes damaged or lost. However, in the event of a natural disaster, emergency, or other unavoidable circumstances, the hospital may temporarily suspend or stop the service.
(3) If the hospital determines that opinions or complaints filed by members through the prescribed procedures are justified, it shall process them through appropriate procedures. If the processing takes a certain period of time, the hospital shall inform the member of the reason and the processing schedule. (4) The hospital shall
comply with the provisions set forth in Article 4 of Chapter 2 in relation to the protection of the privacy of members. (5) The hospital
shall endeavor to provide convenience to users in procedures and contents related to contracts with users, such as the conclusion of a service agreement, changes to contract terms, and termination.
Article 2 (Member Obligations)
(1) Members must comply with the provisions of these Terms and Conditions and any notices or announcements made by the hospital, such as service usage guidelines or precautions, and must not engage in any other acts that interfere with the hospital’s business.
(2) Members are fully responsible for managing their IDs and passwords. Members are responsible for all consequences arising from negligence in managing or misusing the IDs and passwords granted to them.
(3) If a member discovers that his or her ID or password has been misused, he or she must immediately report it to the hospital, and the member is responsible for all consequences arising from failure to report it.
(4) Members must comply with any usage restrictions that the hospital posts in its service notices or announces separately, depending on the content.
(5) Members may not engage in business activities using the service without the hospital’s prior approval, and the hospital shall not be held responsible for the results of such business activities or for the results arising from business activities that violate the terms and conditions. If the hospital suffers damages due to such business activities, the member shall be liable for compensating the hospital for the damages.
(6) Members may not transfer or donate their right to use the service or other contractual status to others without the hospital’s explicit consent, and may not provide it as collateral.
(7) Members may not commit any of the following acts in relation to the use of the service:
① Stealing another member’s ID and password
② Reproducing information obtained through this service for purposes other than the member’s use, or using it for publishing or broadcasting, or providing it to a third party, without the hospital’s prior consent.
③ Posting, distributing to others by e-mail or other means content that infringes
on others’ patents, trademarks, trade secrets, copyrights, or other intellectual property rights. ④ Transmitting, posting, distributing to others by e-mail or other means information, sentences, figures, etc. that are vulgar or
obscene and violate public order and morals. ⑤ Transmitting, posting, distributing to others by e-mail or other means content that is insulting or threatening and may infringe on others’ privacy.
⑥ Acts that are objectively judged to be related to crime.
⑦ Collecting or storing personal information of other users without the hospital’s approval.
⑧ Other acts that violate relevant laws and regulations.

Chapter 4 Use of Member Services
Article 1 (Fees, paid information, and payment, etc.)
(1) All persons registered as members can use the service free of charge.
(2) If the hospital charges for the service, it must announce the timing, policy, and cost of the charge on the service prior to implementing the charge.
Article 2 (Provision of Information)
(1) The hospital may provide various information deemed necessary for members while using the service through notices or e-mail.
(2) The hospital may provide information related to services (medical, healthcare) through various delivery methods (telephone, notices, e-mail, etc.) in order to provide better service benefits to members.
In this case, the hospital may provide medical newsletters sent by a contracted company, not for commercial purposes, to members via e-mail for the purpose of promoting national health. Of course, medical newsletters will not be sent if members do not agree to receive e-mails when registering as members.
(3) However, if a member expresses their intention not to receive service benefit information, the hospital must exclude the member from the information provision target, and the hospital shall not be held responsible for any disadvantages that may arise due to exclusion from the target and failure to receive service information.
(4) The content provided in the service is general and general, and is provided for the purpose of providing information only. The information or consultation provided in the service can never replace a medical diagnosis. The information or consultation provided in the service is never intended to replace medical diagnosis, treatment, or therapy. If you have any questions or concerns about your health, you should visit a real specialist to receive a diagnosis. Under no circumstances should you ignore a medical diagnosis or delay diagnosis, treatment, or care because of the information provided by the service.
Article 3 (Use of consultation room and reservation service)
(1) The hospital will do its best to maintain security so that the contents of consultations and reservations of members or users of the service are not leaked to third parties other than the consulting doctor and service manager. However, the hospital is not responsible for the disclosure or loss of consultation contents in the following cases.
① If the password is leaked due to the user’s negligence and the consultation contents are disclosed
② If the user deletes the contents using the ‘Delete consultation’ or ‘Delete reservation’ function
③ If the consultation or reservation contents are disclosed or lost due to a natural disaster or other circumstances beyond the hospital’s control
(2) The contents of consultations conducted in the service may be used for the following purposes after deleting personal information.
① Academic activities
② Authoring activities such as printed materials and CD-ROMs
③ Part of the service contents such as FAQs and recommended consultations
(3) If you apply for the following consultations, the consultation service may not be provided in whole or in part.
① When requesting consultation repeatedly on the same topic
② When requesting consultation using expressions that go against common sense
③ When requesting consultation requesting a diagnosis
④ When requesting consultation on treatment costs, examination costs, drug prices, etc.
(4) Consultation and reservation services may not be available 24 hours a day depending on the personal circumstances of the professional responding or processing.
Article 4 (Member’s Postings)
The hospital may delete, without prior notice, content posted or registered by members within the service if it determines that such content falls under any of the following items.
① If the content defames or slanders other members, hospitals, or third parties and damages their reputation
② If the content violates public order and morals
③ If the content is deemed to be related to criminal acts
④ If the content infringes on the copyrights of the hospital, the copyrights of third parties, or other rights
⑤ If the posting period specified by the hospital has been exceeded
⑥ If a member posts obscene materials or links to obscene websites on his or her homepage or bulletin board
⑦ If the posting does not conform to the nature of the bulletin board
⑧ If the posting is deemed to violate other relevant laws
Article 5 (Copyright of postings)
The rights to materials posted on the service are as follows.
① The rights and responsibilities for postings belong to the poster, and the hospital cannot use them for commercial purposes other than posting them within the service without the consent of the poster. However, this does not apply to non-profit purposes, and the hospital has the right to post them within the service.
② Members cannot use materials posted on the service for commercial purposes, such as processing or selling information obtained through the use of the service.
Article 6 (Advertisement Intervention and Transactions with Advertisers)
(1) Part of the service investment base that allows the hospital to provide services to members comes from revenues through advertisement posting. Those who wish to use the service are deemed to have consented to the advertisement posting displayed when using the service.
(2) The hospital is not responsible for any loss or damage that occurs as a result of a member’s participation in the promotional activities of advertisers posted on this service or through this service, or as a result of communication or transaction.
Article 7 (Service Usage Hours)
(1) In principle, the service is available 24 hours a day, 365 days a year, unless there are special operational or technical difficulties at the hospital.
(2) The service usage hours in the preceding paragraph may be restricted after prior notice to members when the hospital deems it necessary, such as for regular system maintenance.
Article 8 (Responsibility for Service Usage)
Members may not engage in sales activities using the service to sell products, except in cases specifically permitted in writing signed by an authorized employee of the hospital, and in particular, may not engage in hacking, money-making advertisements, commercial activities through pornographic websites, illegal distribution of commercial software, etc. The hospital shall not be liable for the results and losses of business activities that violate this, legal actions such as detention by relevant organizations, etc.
Article 9 (Suspension of Service Provision, etc.)
(1) The hospital may suspend service provision in the following cases:
① In unavoidable cases due to construction work such as maintenance of service facilities
② In cases where a fixed-line telecommunications service provider as stipulated in the Telecommunications Business Act suspends telecommunications services
③ In cases of other force majeure
(2) The hospital may restrict or suspend all or part of the service when normal service use is hindered due to a national emergency, power outage, service facility failure, or service usage overload.
(3) When the hospital restricts or suspends service use pursuant to the provisions of Paragraphs 1 and 2, it shall promptly notify the member of the reason and period of restriction.

Chapter 5 Contract Termination and Restrictions on Use
Article 1 (Contract Termination)
You may withdraw your membership at any time. To withdraw membership, log in to the hospital website, click on “Withdraw Membership” on the member info page, go through the identity verification process, and directly withdraw membership. Or, contact the personal information protection officer in writing, by phone, or by email. We will promptly take necessary measures, including destroying your personal information.
Article 2 (Restrictions on Use)
If a member commits any of the following acts, the hospital may terminate the service agreement without prior notice or suspend the use of the service for a specified period.
① If another person’s personal information, ID, or password is stolen.
② If the registered name is not the real name.
③ If the same user makes a double registration with a different ID.
④ If an act is committed that damages another person’s reputation or causes disadvantage.
⑤ If the intellectual property rights of the hospital, other members, or third parties are violated.
⑥ If content that is detrimental to public order and morals is intentionally distributed.
⑦ If a member plans or executes use of the service for the purpose of harming national interests or public interests
⑧ If the operation of the service is intentionally disrupted
⑨ If a large amount of information or advertising information is transmitted for the purpose of disrupting the stable operation of the service
⑩ If a computer virus program that causes information and communication equipment to malfunction or information to be destroyed is distributed
⑪ If there is a request for corrective action from an external organization such as the Information and Communications Ethics Committee or an authoritative interpretation is received from the National Election Commission in relation to illegal electioneering
⑫ If the information obtained using the hospital’s service information is copied, distributed or used commercially without the hospital’s prior consent
⑬ If a member posts obscene materials or links to obscene sites on his or her homepage or bulletin board
⑭ If the member violates these Terms and Conditions or other terms of use set by the hospital

Chapter 6 Damages and Indemnification
Article 1 (Damages)
The hospital shall not be liable for any damages incurred by a member in connection with the use of the service while the service fee is free. (However, separate terms and conditions are stipulated in case of paid service)
Article 2 (Exemption Clause)
(1) If the hospital cannot provide the service due to a natural disaster or other force majeure, the hospital is exempt from liability regarding the provision of the service.
(2) The hospital is not liable for any service disruption caused by the member’s fault.
(3) The hospital is not liable for any loss of expected profits by the member using the service or any damage caused by the information obtained through the service.
(4) The hospital is not liable for the reliability, accuracy, etc. of the information, data, and facts posted by the member on the service.
(5) The hospital is not liable for any damage incurred by the member in relation to the use of the service due to the member’s intent or negligence.
Article 3 (Jurisdiction)
If a lawsuit is filed regarding a dispute arising from the use of the service, the court with jurisdiction over the location of the hospital’s headquarters shall be the court of jurisdiction.
